The New York State Police in Herkimer arrested Christopher M. Moerler, 27, on May 1 and charged him with second-degree burglary, third-degree criminal possession of a weapon and fifth-degree criminal possession of stolen property. Also arrested was Anthony C. Zammiello, 18, for second-degree hindering prosecution.
The arrests stem from an arrest warrant issued by the town of Frankfort Police Department on April 30 for Moerler’s arrest for second-degree robbery, second-degree burglary, third-degree assault and third-degree unauthorized use of a motor vehicle for events that took place on April 30.
At approximately 6:30 a.m. on May 1, the ex-girlfriend of Moerler’s call the Frankfort Police to complain about him unlawfully entering her apartment at 134 Furnace Road in the own of Frankfort and he was currently there. The complainant was not at her apartment but stated that she could tell from a telephone conversation that Moerler was inside her apartment. Responding troopers arrived to arrest Moerler and were met there by Zammiello, the complainant’s brother who harbored and aided Moerler when he lied to the troopers saying Moerler was not in the apartment and said he had no idea where he was. Moerler was located by troopers inside the apartment hiding under a rolled up carpet. When located, Moerler possessed property that he had stolen from the apartment the previous day and it was also discovered that Moerler had armed himself with two steak knives that he took from the kitchen of the apartment. Moerler and Zammiello were taken into custody and transported to the State Police in Herkimer.
Zammiello was issued an appearance ticket returnable to the town of Frankfort court May 5 and Moerler was arraigned in the town of Herkimer Court on the State Police and Town of Frankfort Police Department charged. He was then sent to the Herkimer County Jail on no bail.
