  • A Fort Plain man who police believe was driving while intoxicated with two children in his car has been charged with a felony under Leandra’s Law, according to Dolgeville police.
    Keith G. Smith III, 21, of 4560 State Route 10, was pulled over on South Main Street at about 10:32 p.m. Tuesday. Police said they found an open can of beer in the car and two children, ages 10 and 11, in the passenger seats.
    Smith was charged with felony aggravated driving while intoxicated, driving while intoxicated with a blood alcohol content higher than 0.08 percent, having an open container in a vehicle, driving without a valid license, inadequate headlights and two counts of endangering the welfare of a child, police said.
    Smith was arraigned in Manheim Town Court and was sent to Herkimer County jail in lieu of $1,000 cash bail or $2,500 bail bond.
